Basic Policy Regarding Protection of Personal Information

LIXIL Corporation (hereinafter referred to as the "Company") considers suitable management and protection of personal information to be a social responsibility of the Company. The Company shall strive for suitable management and protection of the personal information acquired by the Company (hereinafter referred to as the "Basic Policy"). The group companies of the Company (hereinafter referred to as the "Group Companies") also recognize that the suitable management and protection of personal information is an important responsibility, and therefore, they will also establish their Privacy Policies and strive for suitable management and protection of personal information in accordance with such Privacy Policies.

1. Definition of Personal Information

Personal information means something enabling the identification of an individual existing person and includes the following.

  1. Name, address, date of birth, gender, occupation, telephone number, email address, or the like.
  2. Information that does not enable identification of a specific individual only by use of that information, but enables identification of a specific individual as a result of simple combination with other information.

2. Acquisition, Purpose of Use, and Provision to Third Parties, of Personal Information

  1. The Company acquires the personal information in an appropriate manner within a scope necessary to carry out its business.
  2. The personal information may be used by the following parties:
    1. The Company;
    2. The Company and its affiliated companies; and
    3. Contractors of the Company (including subcontractors of such contractors)
  3. The Company and the companies set forth in ii. and iii. of 2.(2) above (hereinafter referred to as the "Receiving Parties") use the personal information within the scope of the following purposes of use:
    1. For the provision of value-added services of interest to the customer in relation to residential building material products, commercial building material products, exterior products, and residential facility equipment, that are handled by the Receiving Parties (hereinafter referred to as the "Company Products");
    2. For the provision of information by direct mail or email by the Receiving Parties (such as email magazines, and the like, in relation to Company Products); and
    3. For the provision of personal information to the Receiving Parties.
  4. When there is a need for use of the personal information by the Company or by other Receiving Parties, or when there is a need for use for a purpose other than the stated purposes above, except for the circumstances in 3. b., d., e., f., and g. below, the using party and the purpose of use shall be communicated in advance to the customer, and the provision of information or use of information will be performed after obtaining the customer's advance consent.
  5. When a customer contacts the Company with a question or opinion, the communication thereof, such as a telephone conversation, may be recorded. The recordings may be used for confirmation of details of the conversation and provision of more responsive services.

3. Scope of Disclosure of Personal Information

Except for the following circumstances, personal information will be not disclosed or provided to a third party:

  1. When consent is obtained from the customer;
  2. When the individual customer cannot be identified;
  3. When providing personal information to the Receiving Parties within the scope of the purposes of use;
  4. When required for the protection of the life or the property of a person, and there is difficulty in obtaining the consent of the customer;
  5. When particularly required for improvement of public health or the proper rearing of infants and children, and there is difficulty in obtaining the consent of the customer;
  6. When cooperation is required by a national institution or regional authorities for the performance of duties determined by laws or regulations, and there is a risk of impediment to such performance of duties if the customer's consent is obtained; and
  7. When required by laws or regulations.

4. Management of Personal Information

  1. In addition to providing training and education for officers and employees, the Company shall strive for the suitable management of personal information by appointing a person in charge in each department that handles personal information.
  2. The Company shall strive to maintain the security and the like of the website of the Company in order to prevent the unauthorized access, leakage, destruction or alteration of the personal information.
  3. The Company shall conclude non-disclosure agreements with the Receiving Parties in relation to the personal information to procure them to suitably manage and protect such information, and strive to prevent the divulgence, re-provision or disclosure thereof to a third party, or the use thereof for a purpose outside the scope defined in 2.(3) above.

5. Disclosure, Alteration, Addition, Cessation of Use, Deletion, and Cessation of Provision to Third Parties, of Personal Information

  1. Please contact the Company directly in relation to a request by a customer for the disclosure, alteration, addition, cessation of use, deletion, or cessation of provision to third parties, of the personal information of a customer held by the Company. In view of maintaining accuracy and security and preventing leakage of personal information, in the absence of a special procedure pursuant to laws or regulations, any necessary investigation shall be conducted without delay. Only if it can be confirmed that the request relates to the personal information of the customer, the disclosure, alteration, addition, cessation of use, deletion, or cessation of provision to third parties, of the personal information of the customer shall be performed without delay and in accordance with laws and regulations. The Company is not responsible for complying with any request that does not satisfy the requirements for making a request as provided below or any request that is deemed unreasonable based on the investigation.
  2. The customer making the request shall be contacted without delay in relation to the performance or non-performance of the disclosure, etc. as described above. In the event of non-performance, we will strive to provide an explanation of the reason therefore.

    --How to Make a Request for the Disclosure of Personal Information--
    Please prepare the following three documents and send them to the "Contact Center" described in 11. below.
    * Please note that the customer is responsible for any postage fee incurred.
    1) Personal Information Disclosure Request Form
    2) Identification documents of the customer or his/her agent
    Please send the following identification documents.

    When the request is made by the customer A copy of customer's driver's license, passport, health insurance card, or certificate of residence
    When the request is made by customer's agent A copy of customer's and his/her agent's driver's license, passport, health insurance card, or certificate of residence
    A power of attorney authorizing the agent for this purpose (if the agent is a lawyer, the power of attorney must include such agent's attorney registration number)
    A certificate of seal impression of the customer

    3) Self-addressed and stamped envelope
    Please send an envelope that is self-addressed with prepaid postage of 392 yen (82 yen for regular mail fee + 310 for simplified registered mail fee).

    --How to Make a Request for Alteration, Addition, Cessation of Use, Deletion, or Cessation of Provision to Third Parties, of Personal Information--
    Please prepare the following two documents and send them to the Contact Center.
    1) Personal Information Alteration, Addition, Cessation of Use, Deletion, or Cessation of Provision to Third Parties Request Form
    2) Identification documents of the customer or his/her agent Please send the following identification documents.

    When the request is made by the customer A copy of customer's driver's license, passport, health insurance card, or certificate of residence
    When the request is made by the customer's agent A copy of customer's and his/her agent's driver's license, passport, health insurance card, or certificate of residence
    A power of attorney authorizing the agent for this purpose (if the agent is a lawyer, the power of attorney must include such agent's attorney registration number)
    A certificate of seal impression of the customer

6. Provision of Personal Information to the Receiving Parties

  1. The scope of the personal information provided to a Receiving Party shall cover all such personal information except upon receipt of a particular request from the customer.
  2. The personal information may be delivered to a Receiving Party by forwarding a paper document or electronic data, by delivering electromagnetic tape, or by access to a server.
  3. When a request for the cessation of provision of information to a Receiving Party is received from a customer, the provision of the personal information of such customer to the Receiving Party shall be ceased without delay in accordance with the laws and regulations.
  4. The customer making such request shall be contacted without delay in relation to the performance or non-performance of the cessation of provision, etc. as described above. In the event of non-performance, we will strive to provide an explanation of the reason therefore.

7. Exclusion of Liability

The Company is not responsible for the protection, management or other handling of personal information and other information on any third-party websites which have been linked to the Company's website.

8. Compliance with Related Laws and Regulations

The Company shall comply with the laws and regulations of Japan in relation to the personal information.

9. Notification of Changes to Basic Policy

The details of the Basic Policy may be varied as required. Since communication cannot be made with each customer on each such occasion, the latest version of the Basic Policy shall be published as the latest edition on the Company website.

10. Use of Cookies

  1. The Company website includes a page that uses a technology known as "cookies" that enables more convenient use by the customer when accessing the Web on a subsequent occasion.
    "Cookies" are an industry standard technology for the identification of the computer of a customer on a web server. "Cookies" enable identification of the computer of the customer, but do not identify the customers themselves as long as the personal information of the customer is not input. The browser that is used may invalidate the cookie function by changing the settings. However as a result, part or all of the services on the webpage will no longer be capable of use.

    Explanation of Terms related to "Cookies"
    This is one method of identifying a computer that is browsing a homepage on the Web. A cookie may be stored as a file in the customer disk as a small amount of information that is sent to the hard-disk or the browser of the customer from the web server. This is for the purpose of storing information related to the server on the accessing party side. In this manner, even after leaving the webpage, in the event of accessing that page on a subsequent occasion, the computer of the accessing party can be identified since the server can read the "cookie" that is stored in the hard-disk and the browser of the accessing party.
    Although cookies can be used to identify the customer's computer, the customers themselves cannot be identified as long as the personal information of the customer is not input.

  2. The Company may use the data obtained via cookies in the following situations:
    1. When revising or deleting contents to improve customer satisfaction or providing services that are customized for an individual customer; or
    2. When analyzing what interest a customer may have in any service, and when being used to forward effective advertising on the website.
